Do I Have to Buy a Business First?

Are you required to buy a business before you can obtain an E-2 Visa?  The answer is no.  However, you are required to commit funds or assets to the business in a real and irrevocable manner.  It many situations it is possible to condition purchase of the business upon obtaining your E-2 Visa.  Much like buying real estate where funds are held in escrow pending closing of the transaction, when you buy a business, funds may be held in escrow pending issuance of your Visa.

Also, it is important that you are close to the start of actual business opertations.  It isn’t enough to simply be in the process of signing contracts or looking for a businees location.  Of course, if you are purchasing an already existing business, this is no problem.
